Criminal defense requires both sides, the Criminal Defense Attorney and the accused, to work together. Facts will be fast and furious. Some allegations against an accused will be familiar. However, much of the evidence of an accused will appear fabricated or unfair. Defense Attorney and the accused must work diligently to find the facts that help the accused.

Defense Attorneys must be knowledgeable of the law. At the Le Law Group, we start by assessing the allegations. We listen to the accused. It’s always good to get the facts from the accused of several reasons. It allows the defense to see how aware the accused is and to determine the accused’s level of participation. The accused has legal rights that he or she may not be aware of that apply to the case. By listening to the accused, and the accused believing their information matters is key to building rapport.

The law requires the prosecution team to reveal all evidence that favors the accused. If the prosecution team does not disclose all evidence, then it is up to the defense to file pleadings and motions to correct the issue. Defense Attorney must be competent to know what, when, where, who, why, and how good to represent the accused.

In representing criminal defense cases, it’s best to take one’s time. There will inevitably be urgent matters such as a need for a bond or if there is a sudden arrest that calls for immediate legal action. However, a competent defense attorney will know how to stabilize the case. Once a case has stabilized, then the preparation must focus on building legal theories that make up the defense. Key theories consist of dismissals based on no probable cause. Or, mitigation evidence such as self-defense or reasons to request a lesser included offense.

We make sure to review all crime scenes and interview all witnesses. We will take the prosecution’s expert witnesses to the task to determine the chain of custody of evidence or their level of experience in their review of evidence.

At no time should an accused, enter into a plea agreement for convenience. The Le Law Group will not pressure an accused to accept an uninformed and uncorroborated prosecution deal.
